As a result of the increase in house prices, clients are often concerned that if they need to leave their property to enter nursing/residential care, their property will need to be sold to pay care costs.

We will carefully discuss with our clients and their relatives, if appropriate, the position regarding funding for any care in the future and will outline the options available and legal rights which exist.  For example, it may be that you are entitled to free nursing care if you are elderly and in need of specialist medical care. 

Your property may be classed as a disregarded asset and we will be able to advise you accordingly.

It may be appropriate to create a family trust and for the ownership of your home to be transferred to your trustees.  This has several advantages, including:-

• Ensuring that your family/dependents have the security you would want for them

• Responsibility for your home is passed to the trustees

• Peace of mind for you in knowing that your home will be properly looked after even if you are unable to do so yourself
