When a person dies, there are legal processes which have to be followed in order to deal with the administration of the estate. The processes vary depending on whether he/she dies without leaving a will (intestate) or with a will and the type and amount of assets in their name.
The word ‘probate’ is often used to describe these procedures.
At Ridings Law, we have experience in dealing with estates of all types and sizes and approach each case with a sympathetic yet efficient manner. We provide support and assistance at a time when it is most needed.
We can help you with:-
• General advice regarding how to proceed
• Registering the death and arranging the funeral
• Applying for the grant of probate (if there is a will) or a grant of letters of administration (if there is no will)
• Completing the Inheritance Tax account and arranging for payment of any Inheritance Tax
• Collecting the assets
• Paying any debts
• Finalising the income tax position
• Distributing the estate
Our work need not stop once the administration of the estate is finalised – we are able to help with any ongoing work, including:-
• Administering any trusts created by the will or intestacy
• Deeds of Variation to re-organise the estate, for example, to mitigate any future Inheritance Tax
• Assess your own situation – does your own will need reviewing?
• Provide links to our panel of approved independent financial advisers
• Selling and buying properties
Home visits are available for clients who are unable to come to our office, and can be arranged outside office hours by prior appointment.
We are happy to offer a service which suits you – for example, you may want us simply to obtain the grant of probate/grant of letters of administration or administer the whole estate. Alternatively, you may want to use us as a consultancy service, seeking our advise and/or assistance when you need to.
Linda Pratt is an elected member on the Executive Committee of the Law Society’s Probate Section and lectures nationally to students and lawyers regarding the administration of estates.
